Terms of Service

Welcome to MLM Cosmetic. These Terms of Service outline the rules, guidelines, and agreements for utilizing our wholesale glitter and raw material supply services. By engaging with our services, you agree to these terms.

1. Minimum Order Quantities (MOQ)

Our direct-factory MOQ structure is engineered to support fast formulation pilot runs as well as high-volume industrial manufacturing:

• R&D Pilot & Trial Batches: Low trial MOQ starting at 1 kg (2.2 lbs) per SKU, packaged in heat-sealed aluminum foil moisture-barrier pouches.
• Commercial Production: Standard mass production orders packed in 25 kg (55 lbs) export-grade double-lined fiber drums.
• Custom Particle Cutting & Formulation: 5 kg MOQ for custom optical cuts, bespoke hex sizing, or tailored shade development.

2. Sampling and Development

• Complimentary 50g qualification sample pouches are available for qualified cosmetic formulators and manufacturers. International courier dispatch fees apply.
• Custom color matching or bespoke particle cutting lead time is typically 5-7 business days.

3. Payment Terms

• A standard deposit of 30% is required to initiate raw material procurement and mass production.
• The remaining 70% balance must be cleared prior to final shipment release.
• Accepted payment methods include international wire transfer (T/T), Letter of Credit (L/C for high-volume orders), and secure escrow platforms detailed on the formal proforma invoice.

4. Intellectual Property & Confidentiality

We strictly protect proprietary customer formulations, custom blends, and confidential project specifications. Non-Disclosure Agreements (NDAs) are routinely executed prior to formulation development.

5. Quality Assurance and Technical Compliance

Product specifications, test methods, lot-specific COAs, heavy-metal compliance thresholds, and regulatory documentation (TDS, SDS, ISO 22716, FDA/MoCRA facility status) must be agreed upon in the written purchase order. Each shipment is accompanied by a certified batch Certificate of Analysis.

6. Shipping, Incoterms & Liability

Standard shipping terms include EXW (Factory), FOB (Shenzhen/Hong Kong), CIF, and DDP by air or ocean freight. Risk of transit transfers according to the specified Incoterm 2020.

8. Governing Law & Dispute Resolution

These Terms and any commercial supply agreements shall be governed by and construed in accordance with the laws of the People's Republic of China, alongside applicable international trade conventions. Any controversy or claim arising out of or relating to this contract, or the breach thereof, that cannot be resolved through friendly negotiation shall be submitted to the Shenzhen Court of International Arbitration (SCIA) or the China International Economic and Trade Arbitration Commission (CIETAC) in Shenzhen for arbitration in accordance with its then-effective arbitration rules. The arbitral award shall be final and legally binding on both parties.
